This Foam Party Liability Waiver Form is designed to ensure that participants acknowledge and accept the inherent risks with participating in a foam party, or any of the activities involved with Foam Machines.
ACKNOWLEDGMENT OF RISKS: I, on behalf of myself and my child(ren), acknowledge and understand the potential risks associated with participating in a foam party, or any of the activities involved with Foam Machines, including but not limited to slipping, falling, and skin irritation. I understand that despite safety precautions taken by the event organizers and equipment providers, accidents and injuries can occur. Other risks include, but are not limited to, slips, falls, contact with other participants, negligent or wanton acts of other participants, any defects or condition of premises or equipment, insects or wild animals, the effects of the weather including high heat, cold temperatures, storms, and/or humidity. Individuals who are pregnant, have a heart condition, or have previous athletic injuries that may increase vulnerability to injury, should not engage in the Activities.
WAIVER AND RELEASE: In consideration of being allowed to participate in the foam party event, I hereby release, waive, discharge, and covenant not to sue Fiesta De Espuma Miami and its officers, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my child, whether caused by the negligence of the Releasees or otherwise while participating in such activity.
INDEMNIFICATION: I agree to indemnify and hold harmless the Releasees against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs.
PHOTOGRAPHY AND VIDEO RELEASE: I grant permission to Fiesta De Espuma Miami and its affiliates to use photographs and/or videos of my child taken during the event for promotional purposes without compensation to me.
INTOXICATION: I understand that consumption of alcohol or drugs before or during the Activity increases risk to myself and others, and I agree to not participate while under the influence of any intoxicating substances, even if legally prescribed.
I have read this waiver and release agreement, fully understand its terms, and understand that I am giving up substantial rights by signing it. I agree to it freely and voluntarily without any inducement.
